2. Services Description

Tybalye.com provides family photography session organization services. We coordinate photographers, locations, and scheduling for family portraits and events. Our services are subject to availability and may vary based on season, location, and other factors.

3. User Obligations

When using our services, you agree to:

• Provide accurate and complete information when booking sessions
• Arrive at scheduled sessions on time and prepared according to pre-session guidelines
• Notify us of cancellations or changes at least 48 hours in advance
• Treat photographers, staff, and property with respect
• Supervise children during photography sessions
• Not engage in any illegal or harmful activities during sessions
• Pay all agreed fees in full and on time

4. Booking and Payments

All bookings are subject to photographer availability. A non-refundable deposit is required to secure your session date. Full payment must be received prior to the scheduled session unless otherwise agreed in writing. Prices are subject to change without notice until a booking is confirmed with a deposit.

5. Cancellation and Rescheduling

Cancellations made less than 48 hours before the scheduled session will result in forfeiture of the deposit. Rescheduling requests are subject to availability and may incur additional fees. Weather-related cancellations made by Tybalye.com will be rescheduled at no additional cost.

6. Service Limitations

While we strive to provide exceptional service, we cannot guarantee:

• Specific weather conditions for outdoor sessions
• Availability of specific photographers on short notice
• Particular locations if permits cannot be obtained
• Specific poses or shots that may be unsafe or impractical
• That all members of large groups will be perfectly captured in every image
• Exact turnaround times for final deliverables, though we will provide estimates

7. Intellectual Property

All photographs taken during sessions remain the intellectual property of the photographer or Tybalye.com. By engaging our services, you grant us permission to use images from your session for promotional purposes, including on our website and social media, unless otherwise agreed in writing. You receive a license to use the photographs for personal purposes but may not sell, license, or use them for commercial purposes without explicit written permission.

8. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your data as described therein. We implement reasonable security measures to protect your information but cannot guarantee absolute security.

9. Liability Limitations

Tybalye.com's liability is limited to the amount paid for the photography services. We are not liable for:

• Indirect, consequential, or incidental damages
• Loss or damage to personal items during sessions
• Injuries or accidents occurring during sessions
• Dissatisfaction with styling choices or artistic direction
• Technical failures beyond our control
• Force majeure events including but not limited to natural disasters, pandemics, or civil unrest

10. Dispute Resolution

Any disputes arising from these Terms and Conditions shall first be addressed through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with the laws of the jurisdiction where Tybalye.com is registered. The arbitration shall take place in that jurisdiction, and the decision shall be final and binding.

11. Modifications to Terms

Tybalye.com reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after changes constitutes acceptance of the modified terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction where Tybalye.com is registered, without regard to its conflict of law principles.
